If they dubbed in the Jeopardy theme going into commercial, would that help their cause?Robert K S wrote: ↑Mon Jul 11, 2022 4:40 pm The single most important consideration in fair use is whether and to what extent the complained-of use will have an affect on the market for the original copyrighted work. I think a court would hold that in almost all of Jeopardy!'s uses of copyrighted works, the market for the original work would be little or none diminished, and that the use is fair. But it's far from clear under existing case law that this fourth and most important factor would be determinative for all of Jeopardy!'s uses. The context of incorporation of a small excerpt as part of a trivia clue imbues the use with a transformative teaching/scholarship/criticism/commentary character. But remember, in many cases, we're not just talking about short portions of audio clips played as part of clues. We're talking about the music also being used as a subsequent outro to commercial. It's a lot more difficult to make a fair use argument predicated on the teaching/scholarship/criticism/commentary character of trivia clue inclusion when the clip is played for the pure entertainment value of rockin' out as we throw to an ad. The other thing I contemplated is that Sony is perhaps as often as not the rightsholder plaintiff in these sorts of actions, and perhaps wants to avoid creating precedent that would stymie its enforcement of its own rights in its vast recording libraries.

What episodes are those and why are they unseen?
EDITED TO ADD: Okay, I found it mentioned by Seaborgium here: viewtopic.php?p=269518#p269518 (Episodes #4279 and #4280 pre-empted by coverage of the U.S.-led invasion of Iraq.)
Also mentioned in this Twitter thread:
Spoiler
Incidentally, the show would ship a copy of the episode on VHS or DVD to contestants, right? Has anyone approached that contestant, Jay Mahan, as to whether he still has his copy?

Just a hunch, but I bet we see Ken in the first Pluto game.

I hope they do a better job, because whenever I've watched something on Pluto, the commercials are placed randomly in the program (as opposed to, e.g., at the end of the J! Round). They also have very few advertisers, so it's the same damn commercials over and over and over. And no fast forwarding through them.

21 is a safe guess.
The Alex Trebek clip in the promo ("You guys were so dazzled...") comes from show #4624 - Thursday, October 14, 2004 (HOCKEY for $1000), which is indeed a Ken Jennings game.

What?!
Phrasing.
The best thing that Neil Armstrong ever did, was to let us all imagine we were him.

Has anyone come across any information about what we will see when the channel debuts in under 30 hours?

You want to open your Christmas gift on the 23rd and can't wait to see if you are getting a train set, bicycle or lump of coal?
It is what it is and the time will be here soon enough. If info gets out ahead of time about what will be on the Pluto TV channel then you can bet it will be posted here. No news, means no news.

Re: Pluto TV to launch 24/7 J! channel
It's unknown what will air on Monday, but another promo for the channel showed clips from the following episodes:
- October 14, 2004 (Ken Jennings' 57th game with Hockey category, featuring Alex Trebek and Tie Domi)
- November 11, 2011 (Roger Craig's ToC semifinal game)
- July 30, 2013 (Kids Week)
- August 1, 2013 (Kids Week)
- May 16, 2014 (last Battle of the Decades episode)
Therefore, I have a feeling that those five episodes will be shown in the foreseeable future. Here is the promo featuring these clips:
